By accessing or using the Modern Amenities LLC website (the "Site"), submitting a contact or partnership enquiry, opting in to receive SMS text messages, or interacting with the chat assistant on the Site, you ("you" or "your") agree to these Terms of Service ("Terms") and our Privacy Policy, incorporated by reference. If you use the Site on behalf of a company or property, you confirm that you have authority to bind that entity.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SITE AND DO NOT SUBMIT ANY INFORMATION THROUGH IT.

Modern Amenities LLC installs and manages smart vending machines and micro markets inside properties such as apartments, offices, gyms, hotels, student housing, wellness centers, and airports, at no cost to the property. The Site describes these services and provides ways to reach our partnerships team, including:

• A contact form for property and partnership enquiries
• An AI chat assistant that answers questions and can collect your contact details
• Optional SMS text message communications for enquiry follow-up

The Site does not sell products, process payments, or offer any membership, course, or subscription. Nothing on the Site is an offer to enter a partnership agreement; any actual placement of equipment at a property is governed by a separate written agreement between Modern Amenities LLC and the property.

You must be at least 18 years old to submit information through the Site or to opt in to SMS communications. You agree to provide accurate information when you contact us.

a. What It Is

The chat assistant on the Site is an automated tool that answers general questions about Modern Amenities and can collect your name, email, phone number, and property details so our partnerships team can follow up.

b. Not a Binding Offer

Responses from the chat assistant are for general informational purposes only and do not constitute a binding offer, quote, or commercial term. Contract length, revenue-share terms, and other partnership terms are set only in a written agreement with our team.

c. Please Do Not Share Sensitive Information

Do not submit passwords, payment card numbers, government identification numbers, or other sensitive personal information through the chat assistant or the contact form.

a. Program Description

If you provide a mobile phone number and opt in, you may receive SMS text messages related to your enquiry, including confirmations, follow-up from our partnerships team, and appointment reminders.

b. Opt-In Consent

By providing your mobile phone number and checking the applicable consent box, you agree to receive automated SMS messages from Modern Amenities LLC at that number. Consent is not required to use the Site or to be contacted by other means.

c. Message Frequency

Message frequency varies based on your enquiry and may include multiple messages.

d. Opt-Out

Reply STOP to any message to cancel. You will receive a one-time confirmation that you have been unsubscribed.

e. Help

Reply HELP or contact support@modern-amenities.com for assistance.

f. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

When you submit the contact form, chat with the assistant, or otherwise reach out to Modern Amenities LLC, you authorize us to contact you by email, phone, or SMS (if you opted in) about your enquiry. We use the information you provide to route your enquiry to the right team member and to arrange a site assessment.

All content on the Site, including text, graphics, logos, and the Modern Amenities name and marks, is owned by Modern Amenities LLC or its licensors. Except as needed to use the Site normally, you may not copy, reproduce, modify, or distribute Site content without our written permission.

The Site and its content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. Modern Amenities LLC does not represent that the Site will be uninterrupted, timely, secure, or error-free, or that responses from the chat assistant will be complete or accurate. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODERN AMENITIES LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, INCLUDING SMS COMMUNICATIONS AND THE CHAT ASSISTANT.

You agree to defend, indemnify, and hold harmless Modern Amenities LLC and its affiliates from any claims, damages, or expenses, including reasonable attorneys' fees, arising out of your misuse of the Site or violation of these Terms.

The Site may link to or use third-party services, including analytics, scheduling, and communication tools. Modern Amenities LLC is not responsible for the content or practices of third-party sites or services.

These Terms are governed by the laws of the state in which Modern Amenities LLC is organized, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will first be addressed informally by contacting us; if it cannot be resolved informally, it will be resolved through binding arbitration or in a court of competent jurisdiction as permitted by applicable law.

We may revise these Terms from time to time. We will post the updated version on the Site and update the "Last Updated" date. Continued use of the Site after changes take effect constitutes acceptance.
